Terms and Conditions – Cycle Peru
Please read these Terms and Conditions carefully before booking your tour. By completing your booking and submitting payment, you agree to the following terms.
- Booking and Payment
- A non-refundable deposit of US$500 is required to confirm your booking.
- The full balance is due no later than 60 days before the start of the tour.
- If booking within 59 days of the tour start date, full payment is required at the time of booking.
- Payments can be made by bank transfer or PayPal (subject to processing fees where applicable).
- Cancellations and Refunds
By You (the Participant):
- Cancellations must be made in writing.
- Cancellation charges are as follows:
- More than 60 days before departure: Deposit only.
- 59–31 days before departure: 50% of the total tour cost.
- Less than 30 days before departure: 100% of the total cost.
- We strongly recommend purchasing travel insurance that covers trip cancellations.
By Us (the Operator):
- We reserve the right to cancel the tour due to insufficient bookings, natural disasters, political unrest, or other unforeseen circumstances.
- If we cancel the tour, you will be offered a full refund or the option to reschedule.
- We are not responsible for incidental costs (e.g., airline tickets, visas, vaccinations).
- Health and Fitness Requirements
- Participants must be in good physical health and able to undertake moderate activity at high altitudes.
- You are responsible for consulting a doctor before travel, especially regarding altitude sickness and vaccinations.
- We reserve the right to refuse a participant who is unfit or deemed unsafe to ride.
- Insurance
- Travel insurance is mandatory for all participants and must cover:
- Emergency medical expenses
- Personal injury
- Trip cancellation/interruption
- Theft or loss of personal belongings
- Proof of insurance may be requested before the tour starts.
- Assumption of Risk
- By joining the tour, you acknowledge that cycling in Peru (including remote areas and mountain terrain) carries inherent risks including, but not limited to: road hazards, weather extremes, accidents, injuries, illness, or death.
- You voluntarily assume all risks associated with participation and release the tour operator, guides, and affiliates from liability for personal injury, loss, or damage.
- Itinerary and Changes
- The itinerary is subject to change based on weather, road conditions, group pace, or other safety considerations.
- We will make every effort to deliver the planned tour but reserve the right to adjust routes, accommodations, or schedules as needed.
- No refunds are given for changes due to force majeure (e.g. earthquakes, strikes, political unrest).
- Equipment and Gear
- Participants are responsible for the care of any rental equipment (bikes, helmets, panniers, etc.) provided.
- Damaged or lost equipment will be charged at replacement value.
- Participants bringing their own bike must ensure it is in good working order and suitable for the terrain.
- Code of Conduct
- All participants must follow the instructions of the guide(s) and act respectfully toward other group members, locals, and the environment.
- We reserve the right to remove any participant from the tour without refund due to disruptive, unsafe, or illegal behavior.
- Visas and Travel Documents
- It is the participant’s responsibility to ensure they have a valid passport, necessary visas, and meet any entry requirements for Peru.
- No refunds will be given if you are unable to join the tour due to visa or documentation issues.
- Limitation of Liability
- We are not liable for personal injury, death, loss, damage, delay, or irregularity that may be caused by third-party providers, acts of God, or other factors beyond our control.
- Our liability is limited to the price paid for the tour.
- Photography & Media Release
- We may take photographs and videos during the tour for promotional purposes.
- By joining, you consent to the use of your image for marketing unless you inform us otherwise in writing prior to the tour.
- Governing Law
- These Terms and Conditions are governed by and shall be interpreted in accordance with the laws of Peru, and any disputes shall be resolved in its courts.
Agreement
By submitting your booking and payment, you confirm that you have read, understood, and agreed to these Terms and Conditions.
